The State's Motion in
Limine and Motion for Preliminary Determination came before the Court on this date, and in
accordance with the rules of this court,
IT IS ORDERED THAT:
1. Said motion is sustained.
2. Defendant concedes that he will not be
urging a constitutional right to consume marijuana or a claim of jury
nullification.
3. State's request for a preliminary
determination of the validity of a defense of medical necessity is overruled.
However, the State's Motion in Limine is sustained to the extent that the defense shall
not present evidence or argument with respect to such a defense without a hearing and
ruling outside the presence of the jury by the trial judge.
